Agreement to terms
By using this website or engaging JSM Marketing ("we," "us," "our") for services, you agree to these terms. If you do not agree, please do not use the site or our services.
Services
JSM Marketing provides social media management, content creation, paid advertising management, and related services as described on this site and in your individual service agreement or proposal.
Client responsibilities
- Providing timely access to accounts, brand assets, and approvals needed to do the work
- Providing accurate information about your business and offerings
- Reviewing and approving content within agreed timeframes
- Ensuring you have the rights to any content, logos, or materials you provide to us
Payment terms
Retainer fees are billed monthly in advance unless otherwise agreed in writing. Late payments may result in a pause of services. A minimum initial term (typically 3 months) applies to new retainer agreements, as set out in your service agreement.
Term and termination
Either party may terminate the ongoing engagement with 30 days' written notice after the minimum term has been met. We reserve the right to pause or end services for non-payment or a breach of these terms.
Content ownership
Once paid in full, final approved content created for a client belongs to that client. JSM Marketing retains the right to display completed work in its own portfolio and marketing materials unless the client requests otherwise in writing.
Disclaimer
We do not guarantee specific follower counts, engagement rates, or revenue outcomes. Social media performance depends on many factors outside our control, including platform algorithm changes.
Limitation of liability
To the maximum extent permitted by law, JSM Marketing is not liable for indirect, incidental, or consequential damages arising from use of this website or our services.
Governing law
These terms are governed by and construed in accordance with the law of England and Wales, as applied in Wales. The courts of England and Wales shall have exclusive jurisdiction over any dispute or claim arising out of or in connection with these terms, subject to any rights that cannot lawfully be excluded or restricted.
Changes to these terms
We may update these terms from time to time. Continued use of our services after changes take effect constitutes acceptance of the revised terms.
